You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time regarding this and other questions on the subject of data protection.

Privacy policy: www.siteminder.com/de/legal/datenschutzrichtlinien

Storage period

Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose of the data processing no longer applies. If you assert a justified request for deletion or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. retention periods under tax or commercial law); in the latter case, deletion takes place once these reasons no longer apply.

Legal bases for data processing

If you have consented to data processing, we process your personal data on the basis of Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR if special categories of data pursuant to Art. 9 (1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 (1) (a) GDPR.

If you have consented to the storage of cookies or to access to information on your device (e.g. via device fingerprinting), the data processing is additionally based on Section 25 (1) TDDDG (German Telecommunications Digital Services Data Protection Act). Consent can be withdrawn at any time.

If your data is required to fulfil a contract or to carry out pre-contractual measures, we process your data on the basis of Art. 6 (1) (b) GDPR. Furthermore, we process your data if it is required to fulfil a legal obligation on the basis of Art. 6 (1) (c) GDPR. Data processing may also be based on our legitimate interest pursuant to Art. 6 (1) (f) GDPR.

The relevant legal bases in each individual case are stated in the respective sections of this privacy policy.

Transfer of data to third countries

When you use the online booking system, data is transferred to SiteMinder in Australia and to other service providers of SiteMinder, including in the USA (see section 5). There is no adequacy decision of the EU Commission for Australia; the transfer is based on the EU Standard Contractual Clauses (Art. 46 (2) (c) GDPR). For transfers to US companies certified under the EU-US Data Privacy Framework, the adequacy decision of the EU Commission applies (Art. 45 GDPR).

Withdrawal of your consent to data processing

Many data processing operations are only possible with your explicit consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

If the data processing is based on Art. 6 (1) (e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21 (1) GDPR).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Art. 21 (2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. This right of complaint exists without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, deletion and correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may, apart from its storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as bookings or enquiries that you send to us, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our website uses so-called “cookies”. Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

In some cases, cookies from third-party companies may also be stored on your device (third-party cookies). On this website, this applies exclusively to the embedded online booking system from SiteMinder (see section 5).

Cookies that are required to carry out the electronic communication process or to provide certain functions you have requested (e.g. the booking function) (necessary cookies) are stored on the basis of Art. 6 (1) (f) GDPR and Section 25 (2) No. 2 TDDDG, unless another legal basis is stated. We have a legitimate interest in storing necessary cookies for the technically error-free provision of our services. If consent to the storage of cookies and similar recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG); consent can be withdrawn at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Enquiries by e-mail, phone or fax

If you contact us by e-mail, phone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6 (1) (b) GDPR if your enquiry is related to the fulfilment of a contract or is required to carry out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you send us will remain with us until you ask us to delete it, withdraw your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

5. Online booking via SiteMinder

Integration of the booking system

We embed the online booking system from SiteMinder on our “Booking” page. The provider is Online Ventures Pty Ltd (SiteMinder), 88 Cumberland Street, The Rocks, NSW 2000, Australia.

When you open the booking page, a script from SiteMinder (widget.siteminder.com) is loaded and the booking form is displayed in an embedded window (iFrame) from SiteMinder’s servers (including thebookingbutton.com and direct-book.com). For technical reasons, your IP address, browser and device information, the date and time of access and the page accessed, among other data, are transmitted to SiteMinder. This already happens when you open the booking page, even if you do not make a booking.

Processing when you make a booking

When you make a booking, SiteMinder processes the data you enter on our behalf, in particular your name, address, e-mail address, phone number, period of stay, number of guests, selected room and payment details. This data is forwarded to us to process your booking.

Services within the booking system

SiteMinder uses further service providers within the booking system. According to our findings, these include:

  • Amazon Web Services (AWS WAF) for protection against attacks and abusive access
  • Google reCAPTCHA for detecting automated access (bots)
  • Google Tag Manager and other Google services
  • New Relic for technical monitoring of performance and error-free operation
  • LaunchDarkly for controlling program functions
  • Imgix for delivering images

Data such as your IP address and technical information about your device may also be transferred to servers in the USA. Further information can be found in SiteMinder’s privacy policy.

Cookies and local storage in the booking system

The booking system stores information in your browser, including:

  • “aws-waf-token” (cookie) and entries in local storage to protect against attacks and bot access
  • “sm-cookie-consent” (cookie) to store your cookie settings in the booking system
  • Technical entries in local storage for controlling program functions

Statistics and marketing cookies are deactivated by default in the booking system and are only set if you have given your consent there.

Legal bases

Your booking data is processed on the basis of Art. 6 (1) (b) GDPR (pre-contractual measures and performance of the contract). The integration of the booking system when you open the booking page is based on our legitimate interest in a simple and secure online booking directly on our website (Art. 6 (1) (f) GDPR).

The storage of and access to information on your device for the necessary purposes mentioned above is based on Section 25 (2) No. 2 TDDDG, as it is strictly necessary for the booking function you have explicitly requested. If you consent to further cookies in the booking system, the legal basis is Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG; consent can be withdrawn at any time.

Transfer to third countries

SiteMinder is based in Australia. There is no adequacy decision of the EU Commission for Australia; the data transfer is based on the EU Standard Contractual Clauses (Art. 46 (2) (c) GDPR). For transfers to service providers in the USA, the adequacy decision of the EU Commission (Art. 45 GDPR) applies insofar as they are certified under the EU-US Data Privacy Framework; otherwise, the EU Standard Contractual Clauses also apply.

Data processing agreement and storage period

We have concluded a data processing agreement with SiteMinder pursuant to Art. 28 GDPR. Your booking data will be deleted as soon as it is no longer required for the handling of your stay and no statutory retention obligations (in particular retention periods under tax and commercial law of up to ten years) prevent this.
